With these general conditions of sale, MyLuxuryClothings.eu sells and the Customer remotely purchases the tangible movable property indicated and offered for sale on the website www.myluxuryclothings.eu. The contract is concluded exclusively through the internet, by accessing the Customer at www.myluxuryclothings.eu and placing a purchase order according to the procedure set forth on the site itself.

The customer undertakes to read, before proceeding with the confirmation of his order, these general conditions of sale, in particular the pre-contractual information provided by MyLuxuryClothings.eu
In the order confirmation e-mail, the Customer will also receive the link to download and archive a copy of these general conditions of sale, as required by art. 51 paragraph 1 of Legislative Decree 206/2005, amended by Legislative Decree 21/2014.
The user has the option to place a multiple order, but MyLuxuryClothings.eu reserves the right to refuse or cancel orders from specific users. This includes users with whom MyLuxuryClothings.eu is involved in a legal dispute, users who have previously violated the conditions of the purchase agreement, users involved in fraud of any kind, in particular fraud relating to credit card payments, and users who have provided false, incomplete or inaccurate personal information. MyLuxuryClothings.eu reserves the right to evaluate the acceptance of the orders received and will communicate any impossibility of acceptance by e-mail to the customer.

3) How to purchase on the site

The purchase of products on the site can be made in two ways:

By registering for free on the website www.myluxuryclothings.eu. The user will have to fill in the registration form with his personal information, including name, surname, delivery address, e-mail address and a password. Registration confirmed by email will allow the user to access the site and benefit from services such as viewing orders and returns, as well as tracking the status of the order. We do not allow Partners to offer products that are defective or of lower quality than market standards. If a product you ordered is not as described, faulty or of inferior quality, you can return it and we will contact your Returns Partner. Once returned to the Partner, we will issue a full refund for the defective product. We may also consider offering a discount, replacement or repair as appropriate. Shipping costs and reasonable costs incurred in returning products will be refunded. Further details on returns procedures can be found in section 10 of the Terms and Conditions.

As a consumer, you have legal rights in the event of products that are defective or do not conform to the description. Nothing in the Terms and Conditions will affect these legal rights. The products sold by our Partners are intended for home and personal use only. You agree not to use the products for commercial or resale purposes. Furthermore, you agree not to export or transfer the products to countries or territories subject to global embargoes or sanctions, or to individuals listed on the "U.S. Treasury Department's List of Specially Designated Nationals and Blocked Persons List" or the "E.U.'s Consolidated Financial Sanctions List ". 5) Prices

In the event that an IT, manual, technical or other error occurs which involves a substantial and unexpected change in the sale price which makes it excessively high or negligible, the order will be considered invalid and cancelled, and the amount paid by the customer will be refunded.

6) Payments

As for the payment methods, it is possible to make the purchase using a credit card, such as Visa, Mastercard or American Express. All transactions are processed through a secure server to ensure maximum data protection. We recommend joining the Verified By Visa or Mastercard Securecode services for greater security of online purchases.

It is also possible to pay by bank transfer. Bank details and order number will be provided by confirmation email. Please transfer the payment to the bank details indicated in the order confirmation. Any bank or transfer charges will be charged to the customer. The order will be shipped after the payment has been credited to the MyLuxuryClothings.eu bank account. The reimbursement of the returned amounts will be made by bank transfer to the bank account used for the payment of the order.

If no payment is received within 5 working days, the contract will be terminated and the order will be cancelled. The user will be informed by e-mail, and in case of credit after this deadline, the amount will be refunded.
The shipment of the products will take place when the transfer will actually be credited to the bank account and the goods will be available in the warehouse.
Please check the availability of the bank transfer payment method in the shopping cart at the time of purchase, as it is active for all European Union countries.

7) Shipping and delivery

The shipment of the products by MyLuxuryClothings.eu will take place only after confirmation of payment by the user. The risk of loss or damage to the products, unless it is attributable to MyLuxuryClothings.eu, will be transferred to the user when the user or a third party designated by him, other than the courier, actually comes into possession of the products.

The estimated delivery date of the products will be indicated in the order confirmation email. In the event that an approximate delivery date is not communicated, we will guarantee delivery within 30 days from the date of dispatch. We will be responsible for delivery services and will endeavor to deliver your order by the due date (if stated). However, in some circumstances, delays in delivery may occur due to events beyond our reasonable control (further details in section 18 below). We will do our best to arrange delivery of the products as quickly as possible, but we will not be liable for any losses arising from such delays.

8) Returns

If, after purchasing a product and receiving it, you are not satisfied for any reason, you may return the unworn items within 14 days from the date of receipt for a size/color exchange or a refund. The return or exchange of the product will be possible under certain conditions:

Items must not have been worn, washed or altered and must not show signs of use.
The soles of the footwear must be in perfect condition and must not show signs of any kind.
All footwear and accessories must be returned with the security seal intact along with the original box, which is considered an integral part of the product and must not be damaged, altered or used as the sole outer packaging.
Each item must be returned with all labels and tags attached, and must include all original packaging and accessories (such as dustbags, hangers, coat covers, etc.) received with the order.

Returns must be shipped inside the MyLuxuryClothings.eu box, which must be sealed with tape. If not available, another suitable packaging may be used to ship the items.

9) Withdrawal

The user, as a consumer, has the right to withdraw from the purchase without penalty within 14 days from the date of receipt of the products. In the event that the customer has made multiple purchases with a single order and the products have been delivered separately, the 14-day period starts from the date of receipt of the last product. To exercise the right of withdrawal, the customer must communicate it to MyLuxuryClothings.eu through an explicit declaration of intention to withdraw or using the standard withdrawal form, not mandatory, provided in Annex I of Legislative Decree 21/2014, example:

In the case of exercising the right of withdrawal, the customer is required to return the goods within 14 days of communicating the withdrawal to MyLuxuryClothings.eu. The products must be returned intact, in the original packaging, complete with all parts and tax documentation. MyLuxuryClothings.eu will refund the amount of the products within a maximum of 14 days, including the delivery costs paid by the customer, with the exception of any additional costs in the event that the customer has chosen a delivery method other than the least expensive one offered by MyLuxuryClothings.eu

The refund will be made using the same payment method chosen by the customer at the time of purchase. In the case of payment by bank transfer, the customer must provide MyLuxuryClothings.eu with the IBAN, SWIFT and BIC necessary for the refund. In case of withdrawal for a purchase made with a gift card, the amount will be returned to the customer.

10) Complaints

These General Conditions of Sale are governed by Italian law.
For any dispute concerning the application, execution and interpretation of these General Conditions of Sale, the court of the place of residence or domicile of the user will have jurisdiction, if located in the territory of the State.

However, in the event that the customer has presented a complaint directly to MyLuxuryClothings.eu and it has not been possible to resolve the dispute, and without prejudice to the right of the consumer user to appeal to the competent ordinary judge, it is possible to optionally resort to mediation procedures and out-of-court dispute resolution via the website: https://webgate.ec.europa.eu/odr

11) Limitations of Liability
